Terms & Conditions

The traveler's agreement with OpenWinds is detailed in these Terms and Conditions, applicable to all bookings or arrangements with OpenWinds LLC, a U.S.-based business registered at 8735 Dunwoody Place, Atlanta, GA 30350, USA.

VALID IDENTIFICATION:

All travelers of any age must possess valid passports or government-issued IDs before booking. Identification must be valid for at least six (6) months beyond the return date of the itinerary.

HEALTH AND MOBILITY:

Travelers must disclose any health or mobility issues that could affect their participation in the tour. OpenWinds reserves the right to decline or remove travelers from participation if their conditions significantly impact the tour experience.

REPRESENTATION AND BOOKING:

Bookings for all products must be made through the official website. OpenWinds will issue an invoice within 24 hours, valid for 48 hours.

A surcharges may apply for bookings made within 10 days of departure or during peak travel periods.

PAYMENTS, CANCELLATION, AND REFUNDS:

Cancellation policies are specific to each tour and listed on the tour’s page. To qualify for a refund (if applicable per the cancellation policy), written cancellation must be received by 10:00 AM EST on the final day of the cancellation period. International wire refunds are subject to a $45 processing fee.

Payments are accepted via Zelle, wire transfers, and in-person check deposits at Bank of America branches. Checks sent by mail are not accepted.

TOUR PRICING, INCLUSIONS, AND EXCLUSIONS:

Tour prices cover land-based arrangements only, including accommodation, sightseeing, transfers, and services specifically mentioned in the itinerary.

Flights and cruise components are included only where explicitly stated in the tour inclusions or itinerary.

All travel required to reach the tour starting point and to return from the tour end point is the guest’s responsibility. Any internal flights or cruise components included as part of the tour are subject to supplier terms and, once confirmed, may be non-refundable or carry amendment and cancellation charges, irrespective of the tour cancellation policy.

Refunds will not be issued for any unused or partially used services.

City Tours pricing assumes a minimum number of guests traveling together. Optional items such as Indian meals are not included and must be requested during booking.

TRAVELER'S RESPONSIBILITIES:

Travelers must review all booking details upon receipt. Discrepancies must be reported within 24 hours; otherwise, changes may not be possible.

OpenWinds is not liable for issues arising from incorrect traveler information if not corrected within this timeframe.

HOTEL POLICIES:

Hotels may require a refundable security deposit at check-in, payable directly by the guest. Room configurations (e.g., extra beds or bedding types) and special requests (e.g., early check-in) are subject to hotel availability and cannot be guaranteed in advance. Maximum occupancy per room is 4 travelers.

SPECIAL REQUESTS:

Special requests (e.g., dietary, mobility, accommodation preferences) must be made at the time of booking. While OpenWinds will attempt to accommodate such requests, fulfillment is not guaranteed.

INSURANCE REQUIREMENTS:

OpenWinds strongly recommends that all travelers purchase comprehensive travel insurance covering trip cancellations, medical emergencies, evacuations, and other unexpected events.

ROLE OF OPENWINDS AND THIRD-PARTY RESPONSIBILITY:

Group Tours: OpenWinds acts as a reseller of travel services provided by independent third-party tour operators (“Operators”). OpenWinds is not responsible for the operation, safety, or execution of these tours.

Private Tours: These tours are directly managed by OpenWinds using contracted local service providers. While OpenWinds makes every effort to deliver services as listed, we reserve the right to make adjustments to the itinerary or components based on availability. OpenWinds does not guarantee the performance or availability of third-party vendors, such as hotels or transport companies.

TOUR VOUCHERS AND OPERATOR TERMS:

Group Tours: After booking and payment, travelers will receive a tour voucher, subject to processing and confirmation. By participating in the tour, travelers accept the Operator’s terms included in the voucher. OpenWinds does not process refunds for tour cancellations made by the Operator. Customers must request refunds directly from the Operator.

LIMITATION OF LIABILITY AND INDEMNIFICATION:

By booking a tour, travelers explicitly release OpenWinds from all liability, including but not limited to:

  • Personal injury, illness, death, or loss of personal belongings.
  • Misrepresentation, service failures, or modifications by the Operator.
  • Tour disruptions due to force majeure (weather, strikes, political unrest, government actions, etc.)

Travelers agree to indemnify and hold OpenWinds harmless from any claims, damages, or losses arising from participation in the tour.

Under no circumstances shall OpenWinds be liable for any incidental, consequential, indirect, special, or punitive damages. The maximum liability of OpenWinds, if any, shall not exceed the total amount paid by the traveler for the specific booking in question.

TOUR CANCELLATIONS AND REFUNDS:

Group Tours: All Group Tour departures are scheduled in coordination with the designated Operator and are subject to minimum participation requirements and operational considerations. While departures are planned to operate as published and historically do so, OpenWinds does not warrant or guarantee that any specific departure will operate.

The Operator reserves the right to cancel, reschedule, or modify a tour prior to departure for reasons permitted under its terms, including but not limited to insufficient enrollment or circumstances beyond its reasonable control.

In the event a Group Tour departure is cancelled by the Operator prior to commencement of travel, travelers will be offered the option to transfer to an alternative available departure date or receive a refund of amounts paid to OpenWinds for the applicable tour package. Refunds will be processed in accordance with the original form of payment.

For tours marketed as including flights, airfare is arranged as part of the overall package. Airline tickets are issued upon receipt of full payment, typically no later than thirty (30) days prior to departure. Once airline tickets have been issued, a portion of the package price becomes non-refundable due to committed supplier costs and applicable airline fare rules.

OpenWinds assumes no responsibility for airline-imposed penalties, fare differences, supplier charges, or other costs arising from cancellation after ticket issuance.

Private Tours: Payments for Private Tours are non-refundable once confirmed, unless otherwise stated on the package page. Changes are not permitted after confirmation.

ASSUMPTION OF RISK AND NO WARRANTIES:

By booking a tour, travelers accept all inherent travel risks, including but not limited to:

  • Accidents, injuries, or illnesses.
  • Unforeseen delays or disruptions (weather, political unrest, security risks).
  • Condition of accommodations, transportation, and local infrastructure.

No Warranties: OpenWinds makes no express or implied warranties regarding any travel services. All tours are provided "as is", and OpenWinds disclaims liability for service quality or suitability.

GOVERNING LAW AND JURISDICTION:

By booking with OpenWinds, travelers agree that these Terms & Conditions are governed by the laws of the State of Georgia, USA, and any legal disputes shall be handled exclusively in Georgia courts.

ENTIRE AGREEMENT:

These Terms & Conditions, along with any pre-departure documentation provided by OpenWinds, constitute the entire agreement between travelers and OpenWinds. This agreement supersedes any prior agreements, representations, or understandings between the parties.
